Worksii Terms and Conditions

These Terms and Conditions ("Agreement") govern your access to and use of the Worksii platform and services provided by TechnoFex Ltd. By creating an account, accessing, or using the platform, you agree to be bound by these terms.

Worksii is a product of TechnoFex Ltd.

1. Definitions

  • Platform refers to the Worksii messaging and automation system.
  • Customer refers to the entity or individual who registers and uses the platform.
  • Services means all products and services provided by Worksii, including messaging, APIs, analytics, and integrations.
  • Wallet refers to the prepaid balance account used for sending messages.

2. Eligibility

To use Worksii, you must:

  • Be at least 18 years old
  • Have the authority to bind your organization to this Agreement
  • Provide accurate and complete registration information

You agree to keep your login credentials secure and are responsible for all activity under your account.

3. Use of Services

You may access and use the platform solely for business communication purposes in compliance with:

  • Applicable laws and regulations
  • Our Acceptable Use Policy
  • Any third-party service rules (e.g., Meta, Twilio, SendGrid)

You are responsible for the content of your messages and for obtaining consent from recipients where required by law.

4. Messaging Wallet and Billing

  • All messages are paid for using a prepaid wallet funded by the Customer.
  • Wallet balances are non-refundable unless required by law.
  • Usage is metered and deducted in real time based on message type, channel, and volume.
  • Auto-top-up can be enabled to avoid service interruptions.

Invoices, usage logs, and billing reports are available via the dashboard.

5. Intellectual Property

All content, trademarks, logos, and platform code are the intellectual property of TechnoFex Ltd. You may not reverse engineer, decompile, or replicate any part of the platform without written consent.

6. Data Protection and Security

We are committed to protecting personal data in accordance with applicable laws including GDPR and UK data protection laws. Refer to our Privacy Notice, Security Policy, and Data Processing Addendum for full details.

7. Service Availability and Support

  • We aim to provide 99.9% uptime on core services.
  • Support is available during business hours by email.
  • Service Level commitments are defined in our SLA.

We reserve the right to perform maintenance with prior notice.

8. Suspension and Termination

  • Breach this Agreement or Acceptable Use Policy
  • Fail to maintain wallet balance
  • Use the platform for unlawful or abusive purposes

Upon termination, data will be deleted in accordance with our retention policy.

9. Limitation of Liability

TechnoFex Ltd is not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Third-party service disruptions or delays

10. Modifications

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.

We will notify users of material changes via email or platform notice.

11. Governing Law

This Agreement is governed by the laws of the United Kingdom. Any disputes arising out of or in connection with this Agreement shall be resolved in the courts of London, UK.
